1. Who we are

2. What we offer

NeuroMindy is an AI companion designed for neurodivergent people. You can type, speak, or share an image, and it answers in clear text. It can help with everyday tasks, learning, and planning, and offers a calm space to think. It has different modes (such as Everyday, Teaching, and Coaching).

MindyPlay is our line of mobile games.

Our services are intended for personal use, and for families, schools, and organisations who support neurodivergent people. We may add, change, or remove features over time.

3. About the AI, and its limits

NeuroMindy is an artificial intelligence. It generates responses automatically. It can be helpful, but it can also be wrong, incomplete, or misunderstand you. Please use your own judgement and do not rely on it for important decisions without checking.

NeuroMindy is not a medical, psychological, legal, or financial professional. It does not diagnose, treat, or give professional advice. It does not replace a doctor, therapist, lawyer, or any qualified professional. If you need professional care or advice, please reach out to a qualified person.

NeuroMindy is not a crisis or emergency service. If you are in danger, or it is an emergency, contact your local emergency services right away. NeuroMindy may share support contacts or helplines, but it cannot guarantee they are always available or suitable for your situation.

4. Your account

You can use some features without an account. For certain features (such as voice, images, and saving your settings), you will need a free account. You are responsible for keeping your account details safe and for activity under your account. Tell us right away if you think someone else is using it.

To create an account you must be 18 or over.

5. Using our services properly

You agree to use our services only for lawful purposes. You must not: use them for illegal activities; harass, harm, or abuse others; try to break or bypass our security; reverse-engineer our software; use unauthorised bots or automation; or resell or redistribute our services without our permission.

You must not use NeuroMindy to generate harmful, illegal, or abusive content, or in ways that could harm yourself or others.

6. Your content

If you write, upload, or share content through our services, you keep ownership of it. You give us a limited, non-exclusive licence to use, store, and process that content only to provide and improve our services, as described in our Privacy Policy. You are responsible for what you share and confirm it does not break the law or others' rights.

7. Our intellectual property

All content, software, designs, and materials we provide (including NeuroMindy, MindyPlay, and our brand) are protected by intellectual property laws and belong to MINDYWORLD OÜ. You may not copy, modify, distribute, or create derivative works without our written permission.

8. Privacy and data protection

Your use of our services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data. We comply with the European Union's General Data Protection Regulation (GDPR). Where our services are used in other regions, including the United States, we aim to handle data in line with applicable local laws.

9. Payments, plans, and renewals

Some features require payment. You will always see the price before you pay. There are no surprise charges. Paid plans may renew automatically unless you cancel before the renewal date. Payments are processed securely through our payment providers. For purchases inside mobile apps, payment is handled by the relevant app store (Apple App Store or Google Play) under their terms.

10. Cancellation and refunds

If you are a consumer in the European Union, you have the right to cancel within 14 days of purchase, in line with EU consumer law. Refunds are processed according to the terms of each service and applicable law. For purchases made through an app store, refunds may be subject to that store's policy.

11. Children and young people

We take the protection of minors very seriously.

MindyPlay games are intended for users aged 13 and over.

NeuroMindy accounts are for adults aged 18 and over. A younger person may use NeuroMindy alongside an adult, on that adult's account and under their supervision. In that case, the adult remains the account holder and is responsible for how the service is used. We do not create accounts for people under 18.

Where we provide NeuroMindy to a school or organisation, use by their members, including minors, is governed by our separate agreement with that organisation, which includes the parental or guardian consent required by law.

We do not knowingly collect more personal data from children than necessary, and we never create romantic, sexual, or otherwise harmful content directed at minors.

12. Service availability

We work to keep our services available, but we cannot guarantee they will always be uninterrupted or error-free. We may suspend the service temporarily for maintenance, updates, or reasons beyond our control.

13. Security

We use appropriate technical and organisational measures to protect your data. You are also responsible for keeping your own devices and login details secure.

14. Third-party services

Our services may link to or integrate with third-party services (for example, payment providers, app stores, or AI infrastructure providers). We are not responsible for their content or practices. Their own terms and privacy policies apply to their parts.

15. Limitation of liability

To the extent permitted by law, MINDYWORLD OÜ is not liable for indirect, incidental, or consequential damages arising from your use of our services. Our services are provided "as is". Our total liability is limited to the amount you paid for the service in the 12 months before the issue arose. Nothing in these Terms limits rights that cannot be limited by law, including consumer rights.

16. Suspension and termination

We may suspend or end your access if you break these Terms, with notice where legally required. You can close your account at any time.

17. Governing law and disputes

These Terms are governed by the laws of Estonia, where MINDYWORLD OÜ is registered. If you are a consumer, this does not deprive you of the protection of the mandatory rules of the country where you live, and you may bring proceedings before the courts of that country.

18. Changes to these Terms

We may update these Terms from time to time. We will post changes on this page and notify users where appropriate. Substantial changes take effect 30 days after notification. Continuing to use our services after changes take effect means you accept the updated Terms.

19. Other terms

Severability: if any part of these Terms is found invalid, the rest still applies. Assignment: you may not transfer your rights under these Terms without our consent; we may transfer ours in a merger, acquisition, or sale of assets, with notice.
